Why the company matters more than the country.
Under the US CLOUD Act of 2018, US authorities can order any US company to hand over data in its “possession, custody, or control”, wherever that data is stored. European soil does not change that.
Qualtrics and Medallia are US companies. If your feedback data sits with them, US authorities can order it handed over, even when it is stored in Europe. And a court can forbid them to tell you.
On 18 June 2025, Microsoft France’s director of public and legal affairs told the French Senate under oath that he could not guarantee French data would not be handed to US authorities.
